Sunnyvale Motorcycle Traffic Laws
Lane Splitting Is Legal. Blaming You for It Isn't Automatic.
California lets riders share lanes, but after a crash, insurers often treat lane splitting as proof the rider was at fault. Our attorneys explain how Sunnyvale riders’ traffic laws apply to your crash, and work to show who really caused it.

The Rules You Rode By Can Decide Your Claim
Riders use their motorcycles for everything from weekday commutes to long weekend rides to the coast. Wherever the crash happened, the questions afterward are the same: were you following the rules of the road, and did the other driver break them?
Traffic law matters in almost every motorcycle case, because the other driver’s insurer will look for any rule you might have bent. We can help if:
You were lane splitting when a driver changed lanes, drifted, or opened a gap into you
The driver claims you were weaving, speeding, or riding on the shoulder
You're unsure whether the way you were riding was legal
You or a family member were seriously hurt and have questions about your rights
Knowing the law is how you answer those accusations, and how we prove the driver was responsible.
After a Lane-Splitting or Traffic-Rule Crash
Get medical care right away.
Your health comes first, and your treatment records anchor the claim.
Describe your riding precisely to the officer.
Which lanes you were between, how fast traffic was moving, and how fast you were going. Vague answers let the report fill in the blanks.
Photograph lane lines, the shoulder, and traffic signs.
Where the lanes and shoulder were is often central to a lane-splitting dispute.
Ask witnesses what they saw of the driver's movements.
Whether the driver signaled, drifted, or swerved matters as much as what you did.
Keep any helmet-camera or dashcam video.
Footage of steady, straight-line riding is strong proof against a weaving claim.
Don't agree that you were "splitting unsafely."
Adjusters may try to get you to accept the label in a recorded call. Send those questions to us.
What You Can Recover After a Traffic-Law Dispute
Motorcycle injuries are often severe, and a claim can include all of the losses they cause:
Medical care, now and later
Hospital stays, surgeries, procedures, and the future treatment your doctors expect you’ll need.
Therapy and rehabilitation
Physical therapy and the rehabilitation it takes to get back on your feet.
Lost earnings and benefits
The wages and benefits you’ve lost, and the income your injuries may keep you from earning.
Pain, scarring, and your motorcycle
Pain and suffering, scarring and disfigurement, and the property damage to your bike.

How We Answer the "Unsafe Rider" Argument
The driver’s side will often argue the rider contributed to the crash by weaving, speeding, or splitting lanes carelessly. We meet that argument with a detailed investigation, working with accident reconstruction specialists to show what actually went wrong:
- Scene evidence: lane markings, the shoulder, signals, and sightlines
- The police report, and whether it describes your lane position accurately
- Witness statements about both vehicles’ movements
- Video from cameras, dashcams, or your own helmet camera
- Reconstruction of speeds, spacing, and the moment of impact
- Your license, gear, and riding history
The goal is simple: prove that the driver’s negligence, not your lawful riding, caused the crash.
California Traffic Laws That Matter Most to Riders
Lane splitting is allowed
Riding between two lanes of traffic lets motorcycles pass slower or stopped vehicles. Most states prohibit it; California permits it, and Vehicle Code Section 21658.1 addresses the practice.
It must be done safely
Riders who split lanes are expected to do it in a safe and prudent manner. That means no weaving between lanes, and no splitting on the shoulder.
Every other rule still applies
While splitting lanes, riders must obey all other traffic laws: no speeding, reckless riding, distracted riding, or riding under the influence.
Fault is shared, not all-or-nothing
If a court finds you partly responsible, for example for splitting lanes unsafely, your damages are reduced in proportion to your share of fault. You can still recover the rest.

Sunnyvale Motorcycle Traffic Law FAQs
Is lane splitting legal in Sunnyvale?
Yes. California allows motorcycles to ride between lanes of traffic, and that applies in Sunnyvale as everywhere in the state. It must be done safely, and riders must still obey every other traffic law.
Can I ride on the shoulder to get past traffic?
No. Lane splitting doesn’t extend to the shoulder of a highway. Riding there can be used against you if you’re hit.
What counts as unsafe lane splitting?
Weaving between lanes, speeding, riding recklessly or distracted, or splitting while impaired. Those are the arguments insurers raise, and we answer them with evidence of how you actually rode.
I was lane splitting when a driver hit me. Can I still recover?
Yes. Lane splitting alone doesn’t make you at fault. If a driver changed lanes or drifted into you without checking, that driver can be responsible for your injuries.
What if the driver proves I was partly at fault?
You can still recover. Your damages are reduced by your percentage of fault, and the driver’s insurer pays the rest.
Do motorcycle riders have to follow the same traffic laws as drivers?
Yes. Riders follow the same speed limits, signals, and rules of the road as everyone else, with lane splitting as the main difference.
What does it cost to hire you?
Nothing upfront. We work on contingency, so you pay a fee only if we recover compensation for you.
