This San Jose personal injury case involved a collision caused by an improper left turn. Our clients were passengers in an SUV when the at-fault driver, operating a commercial truck, attempted a left turn from an improper lane and struck the passenger side of their vehicle. The San Jose Police Department determined the collision was caused by the other driver.
The case involved clear liability, but the value of the claim still had to be proven.
The primary injured client was evaluated at the scene by paramedics and transported by ambulance for head, neck, and back pain. She was later evaluated in the emergency department and diagnosed with a closed head injury, whiplash injury, and right trapezius strain.

As her symptoms continued, she underwent additional medical care for neck pain, low back pain, headaches, radiating symptoms, weakness, post-concussion symptoms, memory issues, and difficulty with daily activities.
Her treatment included emergency care, chiropractic treatment, MRIs, pain management, and epidural injections to neck and back.
Despite the extent of the treatment and documentation, the insurance carrier initially offered $100,000.
Our office did not believe that amount fully reflected the evidence. We continued negotiating based on the liability facts, medical records, diagnostic findings, treatment history, future care recommendations, wage loss, and the overall impact on the client’s daily life.
The case ultimately resolved for $384,500.
That represents an increase of $284,500 from the initial offer.
This result is a strong example of why details matter in personal injury cases. A diagnosis alone does not tell the full story. The treatment timeline, consistency of symptoms, objective findings, procedures, future care needs, wage loss, and daily limitations all have to be organized and presented clearly.
This case also wasn’t just about medical bills. It was about a person trying to keep working, caring for family, and living through daily pain while also dealing with headaches, cognitive symptoms, and the stress of a long recovery.
In this case, Solution Now Law Firm was able to use the medical documentation and liability evidence to push the case beyond the initial offer and secure a substantially higher settlement for the clients.
