Months for Most Injuries. A Lifetime for These.

Any injury can upend your work and home life for a while. A catastrophic injury is different: it substantially reduces your physical or cognitive function, so you can’t live the life you lived before. It may end a career, take away the hobbies and pursuits you loved, and change who does what in your family for years to come.

Spinal cord damage with permanent paralysis is the clearest example. Severe burns, serious brain trauma, internal organ damage, and injuries that cause amputation or the loss of a limb’s function often qualify too.

You may have a catastrophic injury claim if:

  • Someone else's negligence caused your accident, in whole or in part

  • Your injury has permanent or long-lasting effects on how you move, think, work, or care for yourself

  • You face ongoing treatment, therapy, assistive equipment, or changes to your home or vehicle

  • The injury happened within roughly the last two years

When someone else’s negligence caused this, you have the right to demand they pay for all of it. The consultation is free, and you pay nothing unless we win.

First Steps After a Life-Changing Injury

  1. Let treatment come first.

Get immediate care, even if some injuries seemed minor at first, and follow every referral. Ask for copies of discharge papers and treatment plans.

  2. Have someone document everything.

Photos of the scene and your injuries, witness names and numbers, and the accident report. A family member or friend can do this while you’re in care.

  3. Keep a running list of costs.

Medical bills, equipment, travel to appointments, home help, and every day of missed work. Long-term costs start adding up on day one.

  4. Think in years, not weeks.

Ask your doctors what care, therapy, and equipment you’re likely to need in the future. Those answers shape what your claim should cover.

  5. Don't let an insurer set the number.

Don’t sign releases or give recorded statements. An early offer comes before anyone knows what a lifetime of care will cost.

  6. Call a lawyer while evidence is fresh.

The filing deadline keeps running during a long hospital stay. We take over the legal work so your family can focus on recovery.

Custom-Built for Claims This Serious

A catastrophic injury claim can’t be handled from a template. Each one depends on how the injury happened, who caused it, and what it will mean for the rest of your life.

We start with fault. We investigate the accident, gather witness testimony, accident reports, medical records, and expert opinions, and show that the other party’s negligent or reckless conduct directly caused your injuries.

Then we build the damages case for the long term. Because catastrophic injuries last a lifetime, we identify losses that won’t fully appear until years after your case ends, such as future surgeries, therapy, assistive equipment, home and vehicle modifications, and the career you can no longer pursue, and we put a fair value on each.

We negotiate with the insurance companies for you. Our negotiators spent a combined 50+ years inside the insurance industry. Most catastrophic injury cases settle before trial, but if a fair settlement isn’t offered, we prepare your case for court and represent you there.

What a Catastrophic Injury Claim Should Cover

Your claim must account for past and future losses, both economic and non-economic, including those that will keep growing after your case is over.

Long-term medical care

Hospital care, surgery, rehabilitation, physical therapy, assistive equipment, and future care your doctors expect you to need.

Lost income and working capacity

Wages you’ve already lost, and the earnings you’ll lose if you can’t return to your job, or to any work.

Home and vehicle modifications

Ramps, accessible bathrooms, adapted vehicles, and other changes a permanent disability requires.

Pain, trauma, and a changed life

Physical pain and discomfort, psychological trauma, emotional distress, lost enjoyment of life, and the effect on your marriage and family.

California Law After a Catastrophic Injury

"Catastrophic" describes the injury, not the claim

The law has no special claim for catastrophic injuries. The term describes how severe and lasting an injury is; your case still has to prove the other party’s negligence caused it.

Two years to file

California Code of Civil Procedure Section 335.1 generally gives people hurt through another person’s negligence two years from the accident to file suit, including after a catastrophic injury. Claims against a government entity can require a formal claim within six months.

Partial fault doesn't bar recovery

California follows pure comparative negligence: your compensation is reduced by your share of fault, never eliminated.

Punitive damages have a high bar

They’re available only when the defendant acted with malice, oppression, or fraud, not for ordinary carelessness, however severe the injury.

Protect the Claim That Protects Your Future

A catastrophic claim is only as strong as the records behind it. You have a legal duty to limit your losses: follow your doctors’ orders, attend your therapy, and don’t push beyond what your care team allows. A gap in treatment gives the defense an argument that your losses are smaller than they are.

Three habits protect you and your family:

  • Keep a recovery journal. Pain, setbacks, appointments, and the everyday things you can no longer do. Family members’ observations belong in it too.
  • Save every receipt. Prescriptions, mileage, equipment, home help, and modifications to your home or vehicle.
  • Send every insurer to us. An adjuster who hears “I’m doing a bit better” may use it to shrink a claim that has to last a lifetime.

We coordinate with your medical providers so billing can wait until your case settles.

Yes. Under California’s comparative negligence rule, your compensation is reduced in proportion to your share of fault, but you can still recover. We make sure fault is assessed on the evidence.

With witness testimony, medical records, accident reports, and expert opinions that show the other party’s negligent or reckless conduct directly caused your injuries.

You may be entitled to workers’ compensation. If someone other than your employer, such as another driver or an equipment manufacturer, caused the accident, you may also have a personal injury claim against them. We’ll help you explore every avenue.
