Your Claim Is Against an Insurance Company, Not a Neighbor

California is an at-fault state. When another driver causes your crash, you don’t take that person to court on day one; you file a claim with their insurance company. It sounds like paperwork. In practice, you’re negotiating with a business whose profit depends on paying you as little as possible, and whose adjusters do this every day.

It’s rare for an insurer to pay a claim in full. Far more often, the answer is a denial or a lowball offer, justified with the same few arguments. You may need help with your claim if the insurer:

  • Says its driver wasn't at fault, or that you caused the crash

  • Says your injuries aren't serious enough to pay for

  • Wants a recorded statement before you've finished seeing doctors

  • Makes a quick offer, or stops returning your calls

Every one of these is a negotiating move, not a final verdict. We answer them with evidence, and if the insurer still won’t be fair, we take your case to court.

How to Protect Your Insurance Claim After a San Jose Crash

  1. Get a police report and see a doctor right away.

These two records are the foundation of every injury claim; gaps in either give the adjuster room to argue.

  2. Collect the other driver's insurance details.

Company name, policy number, and the driver’s name and contact information. Photograph the insurance card if you can.

  3. Start a claim file of your own.

Keep every medical bill, receipt, pay stub showing missed work, and photo of the vehicles and your injuries.

  4. Stick to the facts with every insurer.

Say what happened, not who was at fault or how you “feel fine.” Adjusters listen for words they can use later.

  5. Decline the other insurer's recorded statement.

You’re not required to give one, and it’s the adjuster’s best tool for finding reasons to cut your claim.

  6. Don't sign a release or accept the first offer.

Once you sign, the claim is usually closed for good, even if your injuries turn out worse than you thought. Call us first.

What the Insurance Claim Should Pay For

A fair settlement covers far more than the bills already on your kitchen table. We pursue every category of loss the law allows:

Your medical care

Emergency treatment, doctor visits, therapy, medication, and the future care your injuries will require.

Your lost income and expenses

Wages you missed while recovering, reduced ability to earn, and out-of-pocket costs from travel to appointments to household help.

Your human losses

Pain and suffering, emotional distress, scarring and disfigurement, and the strain an injury puts on your relationships. Insurers fight hardest here, because there’s no receipt; that’s exactly why these losses need an advocate.

Coverage beyond the other driver's policy

Many drivers carry only the minimum coverage. When their policy runs out, your own underinsured motorist coverage may pay the rest. We review every policy that could apply.

How We Take Over Your Insurance Claim

The moment you hire us, the insurance company deals with us, not you. No more adjuster calls at dinner, no more requests for “just a few quick questions.”

We open and manage the claim from start to finish:

  • Investigate the crash: the police report, scene photos, camera footage, witness accounts, and vehicle damage
  • Gather every medical record and bill, including the treatment you’ll still need
  • Document lost income and out-of-pocket costs down to the receipt
  • Present a demand the insurer has to take seriously, backed by evidence rather than estimates
  • Negotiate, and push back on every “not at fault” and “not that injured” argument

Our negotiators spent a combined 50+ years inside the insurance industry. We know how adjusters value claims, because we’ve seen it from their side of the table. If the insurer won’t pay what your claim is worth, we file a lawsuit and prepare your case for trial.

California Insurance Claim Basics

California is an at-fault state

The driver who caused the crash is responsible for your losses, and their liability insurer is who pays. That’s why proving fault comes first.

Every driver must carry insurance

California sets minimum auto insurance requirements so injured people have a source of compensation. Minimums are often not enough for a serious injury, which is why we look past the first policy.

A denial is not the end of your claim

If the insurer refuses to pay a fair amount, you can file a lawsuit. You generally have two years from the date of injury to do so, and negotiating with an adjuster doesn’t stop that clock.

Partly at fault? You can still recover

Insurers often assign you a share of the blame to shrink their offer. Under California’s pure comparative negligence rule, your compensation is reduced by your share of fault, never eliminated, and we challenge inflated fault numbers with evidence.

San Jose Car Insurance Claim FAQs

Their insurance company. California is an at-fault state, so you file a claim with the at-fault driver’s liability insurer. A lawsuit is only needed if the insurer won’t pay a fair amount, and even then, the insurer usually pays any settlement or judgment.

No, not without talking to a lawyer. You’re not required to give one, and adjusters use recorded statements to find inconsistencies, downplay injuries, and shift blame onto you.

Because first offers are designed to close claims cheaply, often before you know the full extent of your injuries or what your future treatment will cost. An early offer rarely accounts for lost earning capacity or pain and suffering.

Don’t accept its number. Fault percentages are negotiable and often inflated. Even if you do share some blame, California’s comparative negligence rule only reduces your compensation by your share; it doesn’t bar your claim.

A denial is a position, not a final decision. We review the reason given, gather the evidence that answers it, and if the insurer still won’t pay fairly, we file a lawsuit. You generally have two years from the injury to do that, so don’t wait on a stalled claim.

It still helps. Adjusters ask questions designed to shape your settlement, and what you say in the days after a crash can follow your claim to the end. Injuries that seem minor also have a way of turning out otherwise; a lawyer makes sure you don’t settle before you know.

Many drivers carry only the minimum coverage. Your own underinsured motorist (UIM) coverage may pay the difference, and other liable parties or policies may apply. We look at every one before you settle.

Nothing upfront. We work on contingency; you pay a fee only if we recover for you.
