This Alameda County personal injury case involved a rear-end collision on I-680. Our client was driving northbound in a Honda Civic when vehicles ahead began slowing and came to a stop. He was able to stop behind the vehicle in front of him. The at-fault driver approached from behind and rear-ended our client’s vehicle, pushing it into the concrete center divider.

The California Highway Patrol determined that the other driver caused the collision by violating California’s unsafe speed law. The vehicle damage was significant enough that our client’s vehicle was towed from the scene.

Our client was transported to Regional Medical Center of San Jose, where he was evaluated for right chest pain, right-sided neck pain and stiffness, a jammed left great toe, and a right knee contusion.

As the case developed, his symptoms continued beyond the emergency room visit. He reported right rib pain and low back pain, along with shoulder pain and possible head trauma. A temporary disability placard was provided because of his pain. He then began additional treatment, including chiropractic care, physical medicine evaluation, imaging, podiatry care, physical therapy, acupuncture, and additional chiropractic treatment.

The left foot injury also required significant attention. Our client reported pain in his left great toe, which he associated with slamming his foot against the brakes during the crash. His treatment included podiatry evaluations, physical therapy, and acupuncture.

The insurance company initially offered $70,000.

Our office fought back hard. The case ultimately resolved for $210,000, which is a $140,000 increase from the initial offer.

This case is a good example of why detailed preparation and aggressive negotiation matter. A rear-end collision may sound straightforward, but the value of the case depended on showing the complete medical picture. The claim involved ambulance transport, emergency care, objective spine findings, a documented foot injury, continued treatment, and ongoing limitations affecting mobility, driving, exercise, and family responsibilities.
